Chapter I General Provisions Article 1 this law is formulated with a view to promoting energy conservation in the whole society, improving energy utilization efficiency and economic benefits, protecting the environment, ensuring the development of the national economy and society, and meeting the needs of the people's lives. Article 2 the term "energy" as used in this Law refers to coal, crude oil, natural gas, electric power, coke, gas, heat, refined oil, liquefied petroleum gas, biomass energy and other resources that can obtain useful energy directly or through processing or conversion. Article 3 "energy conservation" as mentioned in this Law refers to strengthening the management of energy utilization, adopting measures that are technically feasible, economically reasonable and affordable to the environment and society, so as to reduce losses and waste in all links from energy production to consumption, and make more effective and rational use of energy. Article 4 energy conservation is a long-term strategic policy of the state for economic development. The State Council and the people's governments of provinces, autonomous regions and municipalities directly under the central government shall strengthen the work of energy conservation, rationally adjust the industrial structure, enterprise structure, product structure and energy consumption structure, promote the progress of energy conservation technology, reduce the energy consumption per unit output value and energy consumption per unit product, improve the development, processing, conversion, transmission and supply of energy, gradually improve the efficiency of energy utilization, and promote the national economy towards energy conservation Type development. The State encourages the development and utilization of new and renewable energy sources. Article 5 the State formulates energy conservation policies and plans, which shall be incorporated into the national economic and social development plans, so as to ensure the rational utilization of energy and coordinate with economic development and environmental protection. Article 6 the State encourages and supports the research and popularization of energy conservation science and technology, strengthens the publicity and education of energy conservation, popularizes scientific knowledge of energy conservation, and enhances the awareness of energy conservation among the whole people. Article 8 the administrative department for energy conservation under the State Council shall be in charge of the supervision and administration of energy conservation throughout the country. Article 11 The State Council and the people's governments of provinces, autonomous regions and municipalities directly under the central government shall allocate funds for energy conservation among the funds for capital construction and technological transformation to support the rational utilization of energy and the development of new and renewable energy sources. The municipal and County People's governments shall arrange energy conservation funds according to the actual situation to support the rational utilization of energy and the development of new and renewable energy. Article 12 the feasibility study report of a fixed asset investment project shall include a special demonstration on the rational use of energy. The design and construction of fixed assets investment projects shall comply with the standards for rational use of energy and energy conservation design specifications. If a project fails to meet the requirements of the standards for rational use of energy and the code for energy conservation design, the authorities that examined and approved according to law shall not approve the construction of the project; if the project fails to meet the requirements of the reasonable energy utilization standard and energy conservation design specification after the completion of the project, it shall not be accepted. Article 13 it is forbidden to build new industrial projects with backward technology, high energy consumption and serious energy waste. A list of industrial projects that consume too much energy and the specific measures for their implementation shall be formulated by the administrative department for energy conservation under the State Council in conjunction with the relevant departments under the State Council. Article 14 the administrative department for standardization under the State Council shall formulate national standards for energy conservation. In the absence of the national standards specified in the preceding paragraph, the relevant departments under the State Council may formulate industry standards for energy conservation according to law and report them to the administrative department for standardization under the State Council for the record. The standards for energy conservation should be advanced in technology and reasonable in economy, and should be continuously improved and improved. Article 15 the administrative department for energy conservation under the State Council shall, in conjunction with the relevant departments under the State Council, strengthen supervision over the industries that produce large quantities and wide range of energy consuming products, urge them to take energy-saving measures, strive to improve the design and manufacturing technology of products, and gradually reduce the energy consumption per unit product of the industry. Article 16 the administrative departments for energy conservation of the people's governments at or above the provincial level shall, together with the relevant departments at the same level, set energy consumption limits per unit product for products with high energy consumption in the production process. The quota of energy consumption per unit product shall be formulated scientifically and reasonably. Article 17 The State shall implement the elimination system for backward and excessively high energy consuming products and equipment. The list of eliminated energy consuming products and equipment with excessive energy consumption shall be determined and published by the administrative department for energy conservation under the State Council in conjunction with the relevant departments under the State Council.
